Agreement
By accessing pptxmailmerge.com (the “Service”, "PPTXMailMerge") operated by Brezium Maciej Brzeziński, EU VAT ID PL5222700746, Poland, EU, you enter a binding agreement under these Terms, the Privacy Policy, and the Cookie Policy.
License & Intellectual Property
- We grant you a non-exclusive, non-transferable, revocable license to use the Service.
- All software, trademarks, and content remain our intellectual property. No rights are assigned or implied.
User Content
- You warrant full copyright and permissions for materials uploaded.
- You are responsible for compliance with local laws regarding sensitive or personal data.
- We act as processor for uploaded files and controller for minimal personal data (see Privacy Policy).
Acceptable Use
- Do not use the Service for unlawful purposes.
- Do not wrap or expose the Service via an API, or build competitive offerings derived from it.
- Do not reverse engineer or probe the platform for vulnerabilities.
- Do not violate, or encourage the violation of, the legal rights of others (for example, this may include allowing Customer End Users to infringe or misappropriate the intellectual property rights of others in violation of the Digital Millennium Copyright Act).
- Do not permit any third party that is not an Authorized User to access or use a username or password for the Services.
- Do not engage in, promote or encourage illegal activity.
- Do not attempt to reverse engineer, decompile, hack, disable, interfere with, disassemble, modify, copy, translate, or disrupt the features, functionality, integrity, or performance of the Services (including any mechanism used to restrict or control the functionality of the Services).
- Do not sublicense, resell, time share or similarly exploit the Services.
- Do not access the Services in order to build a similar or competitive product or service or copy any ideas, features, functions, or graphics of the Services.
- Do not engage in any unlawful, invasive, infringing, defamatory or fraudulent purpose (for example, this may include phishing, creating a pyramid scheme or mirroring a website).
- Do not intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature.
- Do not interfere with the use of the Services, or the equipment used to provide the Services, by customers, or other authorized users.
- Do not disable, interfere with or circumvent any aspect of the Services.
- Do not generate, distribute, publish or facilitate unsolicited mass email, promotions, advertisings or other solicitations (“spam”).
Payments
Subscriptions are processed by Stripe. Charges and taxes appear at checkout.
Chargebacks
- If, at any time, we record a decline, chargeback or other rejection of a charge of any payable Fees on your account (“Chargeback”), this will be considered as a breach of your payment obligations hereunder, and your use of the service may be automatically disabled or terminated.
- In the event a Chargeback is performed, your User Account may be blocked without the option to re-purchase or re-use it, and
any data contained in such User Account, including any domains, applications and Third Party Services may be subject to cancellation.
- Your use of the service will not resume until you re-subscribe for any such Services, and pay any applicable Fees in full.
If you have any questions or concerns regarding a payment made, we encourage you to first contact our Sales team before filing a Chargeback
or reversal of payment, in order to prevent the repercussions described above.
- We reserve our right to dispute any Chargeback received, including by providing the relevant credit card company
or financial institution with any information and documentation proving that the User responsible
for such Chargeback did in fact authorize the transaction and make use of the services rendered thereafter.
Support
For faults, email pptxmailmerge@gmail.com with:
(i) files uploaded; (ii) expected behaviour; (iii) observed faulty behaviour.
Termination
We may suspend or terminate access if you breach these Terms or for any business or legal reason. Termination does not relieve you of obligations incurred before that date.
Limitation of Liability
- Neither pptxmailmerge nor its suppliers shall be liable to you or any third party for any indirect, special, incidental, punitive, cover or consequential damages (including, but not limited to, damages for the inability to use equipment or access data, loss of business, loss of profits, business interruption or the like), arising out of the use of, or inability to use, the product and based on any theory of liability including breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if pptxmailmerge or its representatives have been advised of the possibility of such damages and even if a remedy set forth herein is found to have failed of its essential purpose.
- PPTXMailMerge total liability to you for actual damages, for any cause whatsoever will be limited to the amount paid by you for the service that caused such damage for a maximum period of 6 months.
- The foregoing limitations on liability are intended to apply to the warranties and disclaimers above and all other aspects of this agreement.
- Force majeure. PPTXMailMerge is not liable hereunder by reasons of failure or delay in the performance of its obligations hereunder on account of strikes, shortages, riots, insurrection, war, acts of terrorism, fires, flood, storm, explosions, earthquakes, acts of god, government action, labor conditions, or any other cause which is beyond its control.
Exclusion of warranties
- You expressly understand and agree that your use of the PPTXMailMerge service is at your sole risk and services authored by pptxmailmerge are provided “as is” and “as available.”
- PPTXMailMerge, its subsidiaries and affiliates, and its licensors make no express warranties and disclaim all implied warranties regarding the service, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Without limiting the generality of the foregoing, pptxmailmerge, its subsidiaries and affiliates, and its licensors do not represent or warrant to you that: (a) your use of the service will meet your requirements, (b) your use of the service will be uninterrupted, timely, secure or free from error, and (c) usage data provided through the service will be accurate.
- If applicable law requires any warranties with respect to the service, all such warranties are limited in duration to thirty (30) days from the date of first delivery of the service.
- If you report a breach of warranty to pptxmailmerge then pptxmailmerge will use reasonable commercial efforts to supply you with a version of the service that substantially conforms to the documentation, or refund to you the fees you paid for the service for up to a maximum of the last thirty (30) days at its option. This remedy is the sole and exclusive remedy available to you for breach of express or implied warranties with respect to the product.
Governing Law & Venue
These Terms are governed by the laws of Poland and, where applicable, the European Union. Exclusive jurisdiction lies with the competent courts of Poland.
Changes to Terms
We may modify these Terms; continued use after an update constitutes acceptance. The effective date appears at the top.
